Terms of Service

1. Acceptance of Terms

By accessing or using Esimra ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

Esimra provides a digital storefront for purchasing eSIM data packages for international travel. Upon successful payment, you receive a QR code and activation credentials to install an eSIM profile on a compatible device.

eSIM connectivity is provided by third-party mobile network operators. Esimra acts as a reseller and does not directly operate mobile networks.

3. Eligibility

You must be at least 18 years of age to use the Service. By placing an order, you represent that you meet this requirement and that the information you provide is accurate.

4. Orders and Payment

  • All prices are displayed in US Dollars (USD) and include applicable fees.
  • Payment is processed securely through Stripe. We do not store your credit card details.
  • An order is confirmed once payment is successfully processed. You will receive a confirmation email with your eSIM credentials.
  • We reserve the right to cancel orders if fraud is suspected or if the requested product is unavailable.

5. eSIM Delivery and Activation

  • eSIM credentials (QR code and activation code) are delivered via email and available on your order status page.
  • Your data plan validity period begins when the eSIM first connects to a mobile network in the covered destination, not at the time of purchase or installation.
  • It is your responsibility to ensure your device is eSIM-compatible and carrier-unlocked before purchasing.
  • eSIM profiles are tied to a single device and generally cannot be transferred.

6. Refund Policy

  • Before activation: If your eSIM has not been installed or activated (QR code not scanned), you may request a full refund within 30 days of purchase.
  • After activation: Once the eSIM is installed and has connected to a network, refunds are handled on a case-by-case basis at our discretion.
  • Service issues: If the eSIM fails to work due to a provisioning error on our side, we will either resolve the issue or issue a full refund.

7. Acceptable Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose.
  • Resell, redistribute, or share eSIM credentials with unauthorized parties.
  • Attempt to abuse, exploit, or circumvent the Service's systems or security measures.
  • Use automated tools to scrape, test, or overload our systems.

Violation of these terms may result in order cancellation and restriction from future purchases.

8. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. Network coverage, speed, and reliability depend on local mobile operators and may vary by location, device, and network conditions.

Stated data allowances (e.g., "5 GB") are subject to fair use by the underlying network provider. "Unlimited" plans may be subject to speed throttling after high usage thresholds as determined by the network operator.

9. Limitation of Liability

To the maximum extent permitted by law, Esimra shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

  • Loss of data, business, or profits.
  • Network outages or connectivity issues caused by third-party operators.
  • Inability to use the eSIM due to device incompatibility.

Our total liability for any claim shall not exceed the amount you paid for the specific order in question.

10. Intellectual Property

All content, branding, and software on the Esimra platform are owned by or licensed to us. You may not copy, modify, distribute, or create derivative works without our written permission.

11. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Last updated" date on this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes shall be resolved through good-faith negotiation first, followed by binding arbitration if necessary.
